Renters' Rights, Awaab’s Law, and the Decent Homes Standard: What Surrey Landlords Need to Know

Renters' Rights Bill:

The removal of Section 21 "no fault" evictions might seem worrying, but landlords will still have access to structured grounds for possession. While the court system remains as it is, landlords can still pursue valid reasons for possession, such as rent arrears or anti-social behaviour. These structured grounds ensure that landlords retain the ability to address critical issues, providing reassurance that there are still legal protections in place.  Here are the main points to consider:

  • All Assured Shorthold Tenancies (ASTs) will convert to Assured Periodic Tenancies from day one – meaning no more fixed-term tenancies!
  • No more Section 21 "no-fault" evictions – landlords will need a valid reason to regain possession.
  • No rent in advance before signing – tenants will no longer need to pay before the agreement is in place.
  • Rent advance capped – landlords can only request a maximum of one month’s rent upfront.
  • More reasons for landlords to evict under Section 8 Notices, ensuring fairer rules for regaining possession.
  • Annual rent increases under Section 13 Notices – landlords can increase rent once a year with proper notice.
